New FDA Regulations for shipping food to the U.S.A.

Please be advised that effective December 12th, 2003, the FDA (Food and Drug Administration) will implement new regulations for shipments containing food to the U.S. from all other countries.

These new regulations will affect all customers (business or residential) that process or distribute food products. These changes will require customers to show their FDA registration number and Prior Notification number on the customs documents for any U.S. shipments that contain food (for either human or animal consumption). Also falling under these regulations that require FDA registration number and Prior Notification number is food that is purchased by an individual and sent as a personal gift.

There are some exceptions to the regulations such as food that was made by an individual in his/her personal residence and sent by that individual as a personal gift (i.e. for non business reasons). In order to qualify for exclusion these shipments must be clearly identified as a "gift/home-baked food item", listing the specific items i.e. cookies etc, on the customs documentation.

We strongly suggest that if you are shipping any type of food item (again for either human or animal consumption) that you either contact a customs broker or go to the FDA website at http://www.fda.gov/oc/bioterrorism/bioact.html or http://www.cfsan.fda.gov/~dms/htsguide.html.
